U.S. Sen. Ben Sasse is questioning Immigration and Customs Enforcement about how the agency dealt with a man who was involved in a fatal crash in Omaha while in the United States illegally.
Nemias Garcia-Velasco, 32, is charged with motor vehicle homicide in the fiery crash of a van at the Interstate 80/680 interchange on July 5. Silvano Torres, 58, who was riding unrestrained in the cargo area of the van, was killed.
Garcia-Velasco had a blood alcohol level three times the legal limit and was driving 100 mph at the time of the crash, authorities say.
A citizen of Mexico, he had been removed from the U.S. seven times, authorities said.
In a letter to ICE, Sasse also brought up the case of Sarah Root, who died at 21 after being rear-ended at an Omaha intersection by a man authorities say was in the U.S. illegally and drag racing while drunk.
